Queridos amigos e amigas,

Comprometi-me em vídeo anterior, analisar com vocês, uma das muitas tragédias que se sucedem no mundo, com tendência a  agravar-se nesse mundo que se orgulha com seus sucessos no campo da ciência, da tecnologia e na produção de riqueza. Naquele vídeo me referi aos milhares, brevemente poderão ser milhões de seres humanos,homens, mulheres,idosos,crianças, todos feitos restos humanos, que arriscam a vida fugindo da vida miserável em seus países de origem, miséria a que se somam em geral guerras e organização social ou política humanamente insuportáveis. Essas legiões de excluídos atravessam o Mediterrâneo, como diariamente escancaram a nossos olhos os meios de comunicação, em condições desumanas, na esperança de construir uma nova vida nos Países ricos da União Europeia. Nessa travessia,  milhares deles, perdem a vida, como os judeus no deserto, em sua fuga do Egito.

Tragédia semelhante ocorre no Extremo Oriente, embora aconteça no outro lado do mundo, longe das nossas telas. Mas isto mostra quanto a tragédia da exclusão é universal, e como perduram no mundo as consequências das teorias da concentração do poder, e do enriquecimento de alguns em detrimento de tantos, dos mais fortes, contra os mais fracos.

A Inglaterra,que no longo reinado da Rainha Vitória que cobriu mais da metade do século 19 se vangloriava de seu Império Colonial” onde o sol não  se punha”. Suas colônias, submetidas durante séculos, ocupavam metade da África, parte do Oriente Médio, o Sul e Sudeste da Azia, parte da América. Ela tinha razão .O sol nascia em suas colônias do Extremo Oriente, passava sobre a Azia e a África, se punha na América, tudo no Império da Rainha Vitória. A Inglaterra, no raiar do capitalismo, fez da exploração de suas vastas colônias, sua riqueza, exceção dos Estado Unidos ,que se libertaram no inicio do império colonial, ainda no século 18.

Guardadas as proporções, mais humildes foram as colônias da França, de Espanha e Portugal e mesmo da Bélgica, Holanda ou até da Itália na aventura fascista exatamente na Líbia, de onde agora partem milhares de exilados,a parte evidenciada da miséria,num contexto onde talvez a parte mais desumana,esteja nas áreas  deixadas para traz

Quero dizer que, agora, os países da União Européia, a Inglaterra em primeiro lugar, não tem o direito de esquecer do passado, de lavar as mãos do mundo que exploraram e da tragédia da qual têm parte, e parte não pequena, de responsabilidade histórica.

Não vale o argumento de que preservam a Justiça. Não vale também desconhecer o sentido da solidariedade, que como tenho dito, não pode continuar sendo confundida com mera liberalidade, com filantropia, compaixão, ou com esmola.

Quero dizer que também não vale alegar a Justiça.A Ação dos países europeus, ou em situação semelhante dos países ricos do extremo oriente,tem que ultrapassar o dever da Justiça.Também não podem praticar a solidariedade como uma esmola,ou uma ação meramente humanitária. A solidariedade, nesse mundo de corresponsabilidade global e dessa história compartilhada,constitui um dever que vai além da justiça,que vai além da virtude,que tem que ser praticada como um preceito legal,nas relações entre países,povos ou pessoas.Como a Justiça.

Transcrevo parte do que escrevi no tópico Conteúdo jurídico da Participação e da Solidariedade,do livro que nos inspira Participação e Solidariedade:

“em relação ao conceito de solidariedade, pode-se fazer um paralelo entre o que ocorre e o que, em épocas remotas, ocorria em relação ao conceito de justiça. A justiça constituía um preceito ligado mais à virtude, do que ao direito, ou à lei.

O cidadão não era obrigado a ser justo. O mais forte podia oprimir, escravizar, até matar o mais fraco. Os códigos, em geral, admitiam isto que hoje seria inadmissível: a lei o direito do mais forte prevalecendo sobre o mais fraco, ou sobre a noção da justiça.

Nesta concepção, a justiça era uma virtude, e o homem justo era reconhecido como virtuoso, respeitado por isto – por ser virtuoso, por sua comunidade.

Esta concepção da justiça de então, equivalia, de certa forma, à concepção que se tem hoje da solidariedade. A solidariedade, mais do que objeto da lei, é considerada apenas virtude. A lei não obriga ninguém a ser solidário, embora, às vezes, decisões judiciais invoquem o dever de solidariedade como exigência inerente à plenitude da justiça.

Não basta, entretanto, que o cidadão solidário, como outrora o justo, seja considerado virtuoso e possa ser louvado por sua virtude.

É preciso que a solidariedade se imponha como norma jurídica, envolvendo as relações das pessoas, das organizações e dos países, porque nas condições do absoluto poder da tecnologia, capaz de concentrar tudo, só a solidariedade permitirá realizar justiça.

A globalização, a interdependência, a imensa distância que vai entre os que detêm a riqueza, e, portanto, o poder e a tecnologia, em relação às legiões de excluídos, impõe esse avanço nas instituições nas instituições jurídicas, como forma de viabilizar a sociedade minimamente equilibrada e consequentemente sustentável.”

É necessário que os países da União Europeia entendam, que solidarizar-se, significando a acolhida da parte  rejeitada da humanidade, não é apenas um ato virtuoso, ou humanitário. Mas é um dever irrecusável com a humanidade e dessa forma hão de ser cobrados pelos fóruns dahistória.

The JuridicalContentofSolidarity

Dear friends,

I committed myself in a previous video, to analyze with you, one of the many tragedies that succeed itself in the world with tendency to aggravate in this world that boast itself with its success in the field of science, technology and in the production of wealth. In that video I referred to the thousands, in the near future it’ll be millions of human beings, men, women, elderly people, children, all of them made human rests, that risk their lives fleeing of the miserable life in their countries of origin, misery to which are added in general wars and social organization or humanly unbearable policy. These excluded legions across the Mediterranean, as daily our eyes wide open to the media, in inhuman conditions, hoping to build a new life in the rich countries of the European Union. In this crossing, thousands of them lose their lives, like the Jews in the desert, in their escape from Egypt.

Similar tragedy occurs in the Far East, though it happens on the other side of the world, away from our screens. But this  shows how the tragedy of exclusion is universal, and how in the world endure the consequences of theories of power concentration and enrichment of a few at the expense of so many of the strongest against the weakest.

England, which in the long reign of Queen Victoria that covered more than half of the 19th century boasted of their colonial empire “where the sun never set”. Their colonies, subjected for centuries, occupied half of Africa, part of the Middle East, South and Southeast of Asia, part of America. She was right .The sun rose in its colonies in the Far East, passed over the Asia and Africa, went down in America, everything in Empire of Queen Victoria. England, in the dawn of capitalism, made the exploitation of its vast colonies, their wealth, except the United States, which is released at the beginning of the colonial empire, still in the 18th century.

Saved proportions, most humble were the colonies of France, Spain and Portugal and even Belgium, the Netherlands or Italy to the Fascist adventure exactly in Libya, where now run thousands of exiles, the highlighted part of poverty in a context where perhaps the most inhuman part, is in the areas left behind.

I want to say that, now, the countries of the Europe Union, England in first place, doesn’t have the right to forget about the past, to wash hands of the explored world and of tragedy which are part and no small part of historical responsibility.

It doesn’t worth the argument of that some preserve the Justice. It also doesn’t worth to not know the meaning of solidarity, that how I’ve said, it can’t continue to be confused with mere liberality, philanthropy, compassion, or almsgiving.

I mean, it does not worth claiming justice. The Action of the European countries, or in a similar situation of the rich countries of the Far East, have to overcome the duty of justice. Nor can practice solidarity as a handout or a purely humanitarian action. Solidarity, in this world of global responsibility and this shared history, a duty that goes beyond the justice that goes beyond virtue, which has to be practiced as a legal precept, in relations between countries, peoples or individuals. As Justice.

I transcribe partof what I wrote in the topic Juridical Content of Participation and Solidarity, of the book that inspire us Participation and Solidarity:

“In relation to the concept of solidarity, it can be made a parallel between what happens and what, in ancient times, happened in relation to the concept of Justice. Justice constituted a precept linked more to virtue than to the right, or law.

 

The citizen wasn’t obliged to be fair. The stronger could oppress, enslave, even kill the weaker. The codes, in general, admitted it which today would be inadmissible: the law the right of the stronger prevailing over the weakest, or over the juridical notion.

In this conception, justice was a virtue and the fairest man was recognized as virtuous, respected for that – to be virtuous for his community.

This conception of justice of yore, was equivalent, in a way, to a conception that exists today of solidarity. Solidarity, more than an object of law, is considered only virtue. The law doesn’t forces anybody to be solidary, although, sometimes, judicial decision invokes the duty of solidarity as a requirement inherent in the fullness of justice.

It’s not enough, however, that the lonely citizen, as yore the fair, is considered virtuous and can be praised for his virtue.

 

It’s needed that the solidarity imposes itself as a juridical norm, involving the relation of people, organizations and countries, because in the conditions of absolute power of technology, capable of concentrate everything, only solidarity will allow to perform justice.

The globalization, the interdependence, the huge distance that goes between those that hold wealth and therefore, the power and technology, in relation to the excluded legions imposes this advance in the institutions, in the juridical institutions, as a way to enable the society minimally balanced and therefore sustainable “.

It’s necessary that the countries of the European Union understand that express solidarity, meaning the acceptance of the rejected part of humanity isn’t just a virtuous act, or humanitarian. But it’s an undeniable duty with the humanity and thus they’ll be charged by forums of history.
